Leaves of Absence
With the myriad of leave programs in CA, it’s no wonder that this is the highest litigated area for an employer. FMLA, CFRA, PDL, WC, ADA, CA Parental Leave……what does it all mean and how do you manage it without putting your company in a risky legal position? Easy! Let Monster HR handle it. We know the processes and what documents are necessary to keep you compliant. ADA is on everyone’s mind right now with Covid and the dreaded “medical accommodation” process for exemption. But what so many employers don’t realize is that to be eligible for an ADA accommodation, the employee actually has to have a disability, not just a medical condition. Most employers are not aware of the “interactive process” that is required by law to determine if an employee is eligible for an accommodation. But we are, so let us help you.
California law requires all employers of 5 or more employees to provide 1 hour of sexual harassment and abusive conduct prevention training to nonsupervisory employees and 2 hours of sexual harassment and abusive conduct prevention training to supervisors and managers once every two years. The law requires the training to include practical examples of harassment based on gender identity, gender expression, and sexual orientation. Sounds scary right? Don’t give it another thought.
